Deputy Attorneys General, with critical support from criminal special investigators, victim service specialists, paraprofessionals, and administrative staff, prosecute criminal cases, enforce consumer laws, provide counsel to state agencies, ensure the public's access to open government, protect the abused, and much more.

Summary Statement

The Delaware Department of Justice, Civil Division, Affirmative Litigation Unit (“ALU”), seeks a Deputy Attorney General (“DAG”) to represent the Delaware Division of the Public Advocate (“Public Advocate”). This position is located in New Castle County with travel to Kent County as needed to appear before the Public Service Commission (“Commission”).

Essential Functions

The DAG will be expected to perform the following tasks: Advising the Public Advocate on legal and regulatory matters brought before the Commission;  Drafting and reviewing orders; Reviewing filings made by regulated public utilities and others;  Communicating with utilities regarding regulatory matters, including complaints, public utility statutes, regulations, and policies; Reviewing complaints received by the Public Advocate from regulated utility customers, often requiring interpretation of statutes, regulations, and utility tariffs; Investigating and litigating rate cases and other utility regulatory issues, including drafting discovery, motions, and briefs in connection with such investigations and litigation, and trying cases before hearing examiners or the Commission; Aiding the Public Advocate in drafting proposed legislation to amend the Public Utilities Act or the Public Advocate’s enabling statute; reviewing proposed draft legislation to analyze impacts on the Commission and the Public Advocate; Advising the Public Advocate on legal and regulatory matters at the federal level, including matters pending before federal agencies overseeing utilities (e.g., electric transmission), and drafting comments or complaints to be filed with any federal regulatory agency; Reviewing proposed regulations to implement the Public Utility Act;  Advising the Public Advocate on FOIA; and Other regulated utility-related general duties as assigned by the Public Advocate. The DAG will also represent the Victims’ Compensation Assistance Program Appeals Board. Such representation includes advising Board members regarding the statutory provisions of 11 Del. C. §§ 9001 et. seq.

Job Requirements

The DAG should be self-motivated and able to work independently and meet deadlines. The DAG should have demonstrated legal ability and a thorough knowledge of relevant public utility laws and regulations. The DAG should be able to work with State agencies to identify potential issues and assist with addressing said issues in an effort to minimize and/or avoid future legal action. Delaware Bar membership with no less than 2 years’ experience as a practicing attorney and eligibility for admission to practice in various federal circuit courts of appeal are required.
