Job Description: Director II -Compliance
The Compliance Director reports to the Director of Civil Rights Office (CRO) in the Health and Human Services Commission (HHSC) and manages staff and functions in the Compliance Section. Performs in a progressive, consultative, professional, and technical capacity and coordinates planning, developing, and administering of the Civil Rights Program in compliance with applicable federal/state civil rights laws pertinent to Health and Human Services system; including the Civil Rights Act of , as amended; the Americans with Disabilities Act (ADA) of , as amended; the Texas Commission on Human Rights Act, the Food Stamp Act, USDA/FNS Series, and other federal and state civil rights laws and regulations.

Responsibilities include providing advice and counsel to employees regarding civil rights issues; technical support to managers and supervisors with information about civil rights laws, legislation and methodologies that assist in promoting a nondiscriminatory environment; overseeing investigation of Service-Related Complaints (SRC) and contractor related areas; ensuring compliance with applicable HHS policies prohibiting discrimination; and providing leadership and guidance to supervisors and managers overseeing these areas. Work includes developing HHS guidelines, procedures, and policies for electronic information accessibility, program compliance, and service-related discrimination complaints, Limited English Proficiency (LEP) Program, Section and programmatic recommendations for service-related accommodation requests, ADA programs, Electronic Information Resources (EIR), compliance reviews, data gathering, maintenance and reporting, and recruitment plans. Provides training and Continuous Quality Improvement (CQI) in coordination with Quality Management and Training Team.
Oversees and ensures Compliance Review (CR), EIR, and Service-Related Complaint (SRC) data is logged, equitable, and regularly reviewed for accuracy. Works closely with Deputy Director and Data team on Compliance data and monitoring. Ensures equitability of work to CRO staff in the Compliance Section. Works under minimal supervision with considerable latitude for the use of initiative and independent judgment.
Attends work on a regular and predictable schedule in accordance with agency leave policy and performs other duties as assigned.
Essential Job Functions:
Essential Job Functions:1. Administers and directs CR, SRC, and EIR activities. Develops enterprise-wide program and contractor compliance with HHS policy, and state and federal statutes prohibiting client service-related discrimination. Develops and updates HHS Civil Rights processes, procedures, and guidelines for inclusion in HHS manuals, to establish compliance with HHS Civil Rights and to include effective techniques for evaluating Compliance Review, Service-Related and Accessibility programs, and client services including Section , EIR, and ADA. Implements and maintains accurate and transparent data and reporting in coordination with the data and records team, related to client discrimination complaints, investigations, compliance reviews, routine and ad hoc reports, program trend analysis, and other activities associated with civil rights Compliance Reviews, Service-Related Complaints and Accessibility. Ensures equitable distribution of work to CRO staff in the Compliance Section. (30%)
2. Regularly directs, guides, coaches, and supports managers and supervisors overseeing the work of staff in Electronic Information Resources, Compliance Reviews, and Service-Related Complaints, completing investigations within HHS Civil Rights Office established agency deadlines, and presenting substantiated or unsubstantiated findings to management for final review; completes performance assessments and evaluations; oversees and monitors the completion of staff required performance reports; monitors timelines and provides consultation to management and other employees regarding the internal employee administrative complaint process and all other Civil Rights related matters in accordance with HHS policy; ensures equitable practices and compliance with policies and procedures; determines new trends; identifies and resolves problems; recommends appropriate changes; and implements corrective actions. 3. Identifies and analyzes HHS program demographics; implements programs in support of agency efforts to insure non-discrimination in delivery of services; ensure respect and dignity of clients; identifies problems; advises and recommends appropriate action plans to correct problems; initiates new programs; addresses civil rights program and contractor compliance deficiencies; initiates and oversees studies and analysis of HHS client services and accessibility programs and problem areas; and prepares comprehensive reports of findings and recommendations. (15%)
4. Provides guidance to HHS staff and senior management; oversees the process in the development and integration of new methods and procedures to achieve compliance with state and federal statutes prohibiting discrimination in HHS services for HHS. Conducts surveys and reviews to determine compliance with federal and state requirements, laws, regulations, and HHS policies and procedures; and briefs the Director, senior management, executive staff, legislators, and/or external agencies on trends and results. (10%)
5. Serves as a qualified mediator who prepares resolution agreements; coordinates civil rights related training with Quality Management and Training, Methods of Administration, federal and state Initial and Supplemental Program compliance related training, and ad hoc civil rights compliance training provided to and by CRO staff and external agencies. (10%)

6. Serves in the capacity of the Director when requested. (5%)
Knowledge Skills Abilities:
Extensive knowledge of federal and state civil rights and equal employment opportunity laws including the Civil Rights Act of , as amended, Rehabilitation Act of , Texas Administrative Codes, Age Discrimination Act, the Americans with Disabilities Act, Food Stamp Act, and USDA/FNS Series.
