Duties

ABOUT THE POSITION

This position is located in the Office of General Counsel CMS Division serving as the principal legal advisor and counselor on defensive litigation brought against the Centers for Medicare & Medicaid Services. Directs all aspects of CMSD litigation, including review and evaluation of cases, strategy development, briefing, oral advocacy, and settlement negotiations. Works to ensure consistent legal interpretations throughout the division and with other offices to maintain administrative procedures and policies of the division, Office of General Counsel, and Health and Human Services.

    Qualifications

    Open to all groups of qualified individuals from the public. Current employees within the Federal Civil Service. Current Career SES and SES reinstatement eligibles. SESCDP graduates may also apply for noncompetitive consideration.

    All candidates for SES positions with the Federal Government must demonstrate leadership experience indicative of senior executive level management capability. To meet the minimum qualification requirements for this position, you must show in your resume that you possess the Fundamental Competencies, five Executive Core Qualifications (ECQs), and the Professional Technical Qualifications (PTQ's), listed below. It is recommended that your resume emphasize levels of responsibility, scope and complexity of programs managed, and program accomplishments and results. Typically, experience of this nature will have been gained at or above the equivalent of the GS-15 grade level in the Federal service or its equivalent with state and local government, the private sector, or non-governmental organizations. Failure to meet this basic qualification requirement and all executive and technical qualification factors will automatically exclude you from further consideration.

    Executive Core Qualifications (ECQs):

    Professional Technical Qualifications (PTQ's):

    This position also requires that you possess PTQ's that represent knowledge, skills, and abilities essential for success in this role. The following PTQ's must be evident in your resume.
  • Demonstrated leadership experience overseeing complex litigation involving challenges to significant and novel programs, including Medicare, Medicaid, and ACA title I programs (private market reforms and health care Marketplaces), among others. Requires experience in directing all aspects of defensive litigation, including review and evaluation of cases, strategy development, briefing, oral advocacy and settlement negotiations and appeal recommendations, and working with Department of Justice, CMS, and OGC leadership. Demonstrated leadership experience overseeing litigation of Administrative Procedure Act (APA) issues.
  • Demonstrated leadership experience directing an effective cadre of lawyers and supporting personnel, setting appropriate priorities, and ensuring that the organization meets clients' needs for a high functioning litigation group handling a large volume of extremely complex, high priority litigation.     IF SELECTED, you will be required to complete an ECQ package by drafting narratives for each of the ECQs and be certified by an OPM Qualifications Review Board (QRB) in order to be placed in this position. If you are currently serving in a career SES appointment, are eligible for reinstatement into the SES, or have successfully completed an SES Candidate Development Program approved by the Office of Personnel Management (OPM), you WILL NOT need to draft the ECQs.

    Education

    You must have earned a professional law degree (e.g., J.D.) from a law school accredited by the American Bar Association and be an active member and be in good standing of the Bar in a State or territory of the United States, the District of Columbia, or the Commonwealth of Puerto Rico. You must include a copy of current/active Bar Membership under supporting documents tab "license" and transcripts.

    Foreign Education: If you are using education completed in foreign colleges or universities to meet the qualification requirements, you must show that the education credentials have been evaluated by a private organization that specializes in interpretation of foreign education programs and such education has been deemed equivalent to that gained in an accredited U.S. education program; or full credit has been given for the courses at a U.S. accredited college or university.     Probationary Period:

    An individual's initial SES career appointment becomes final only after the individual successfully completes a one year probationary period.
