POSITION SUMMARY: The Yocha Dehe Wintun Nation’s Legal Department is responsible for providing general legal services to both the Yocha Dehe Wintun Nation and its various commercial and governmental agencies and entities.


ESSENTIAL DUTIES AND RESPONSIBILITIES:

•Provides legal advice and representation on relevant legal matters, including for example, economic development, gaming, taxation, environmental resources, cultural resources, administrative matters, sovereignty, health and welfare issues, and employment law.

•Works with staff in all Tribal enterprises and Departments to address the legal needs of the Tribe and to provide general legal advice as needed.

•Drafts, reviews, negotiates, and analyzes contracts (e.g., construction, software, purchasing,

governmental, employment, labor, agricultural, real estate, leases, gaming, marketing, human resources,

security, maintenance, and environmental agreements) for all aspects of the Tribe’s governmental and commercial operations (including its agencies and businesses).

•Reviews, updates, drafts, and applies Tribal codes, ordinances, and policies to enhance and implement the Tribe’s self-governance objectives.

•Drafts Tribal resolutions.

•Reviews and responds to subpoenas and advises the Resort regarding tort claims.

•Research legal issues (e.g., statutes, regulations, case law, policies), including analysis of legal positions.

•Attends Tribal committee meetings as directed to provide reports on relevant legal issues.

•Assists and supports the Director of Legal, the principal legal advisor for the Tribe.

  • Performs other duties as assigned.


REQUIRED KNOWLEDGE AND EXPERIENCE

Qualifications

The requirements listed below are representative of the knowledge, skill and/or ability required.


Supervisory Responsibilities

Manages the work of the legal assistant/paralegal.


Education and Experience

Juris Doctor (J.D.) degree with a minimum of eight years of law practice experience with a law firm or in-house legal department required. In good standing with the State Bar and have the ability to practice law in California.

Familiarity with federal Indian law and tribal issues is preferred.

Ability to work in a high-performance, fast-paced, high-pressure environment. Ability to effectively multi-task and work independently while remaining organized with unfailing attention to detail and unquestionable integrity. Ability to translate complex legal issues and requirements into understandable terms for easy dissemination across the organization.


Certificates, Licenses, Registrations

Individuals must be able to successfully pass the Tribal Gaming Agency (TGA) Background Check. Must possess a valid driver’s license and maintain a driving record that is satisfactory to the Tribe’s insurance carrier.

Must also hold an active license to practice law in California.
