GENERAL DESCRIPTION:
Perform complex (journey-level) research and analysis of various criminal justice databases for statute requirements to determine eligibility of individual petitions for expunction of criminal arrest records and sealing of juvenile detainment records.
Maintain open communication with the general public and various criminal justice and government agencies.

Work is performed under moderate general supervision with considerable limited latitude, for the exercise of independence and initiative concerning priorities, methods and legal procedures to accomplish assigned duties within the guidelines of the applicable laws, rules, regulations, policies, and procedures.

Work under general supervision, with moderate latitude for the use of initiative and independent judgment.

The following Military Occupational Specialty codes are generally applicable to this position.

ESSENTIAL DUTIES /

RESPONSIBILITIES:


  • Research and review petitions for expunction of criminal arrest records and petitions/applications to seal juvenile detainment records utilizing various criminal justice databases, and analyze and evaluate eligibility according to the appropriate statute requirement.
  • Interpret various criminal codes, regulations, policies, procedures and statutes for the processing of expunction petitions, juvenile sealing applications and court orders.
  • Maintain and update the legal docketing database for expunction and juvenile sealing cases received by the Agency inclusive of pending status of actions and statistical analysis.
  • Evaluate criminal histories to prepare appropriate administrative documents and disposition forms in accordance with charges and information found in the criminal history and forward to appropriate division for updating of the computerized criminal history system.
  • Process expunction and juvenile sealing petitions/applications and orders received from courts; includes ensuring all applicable records are identified, compared and verified for accuracy before being destroyed and/or removed from the various divisions of the Department and relevant state and federal databases.
Notify courts of completion.

  • Review cases for jurisdictional deficiencies and procedural compliance.
Assist in assembling and preparing evidence, exhibits, affidavits and documents for use in legal pleadings and proceedings.
Ensure timely filing of legal documents with courts.
Review orders submitted by attorneys for Agency attorney approval and signature.

  • Prepare denied expunctions for imaging and make appropriate entries in the legal docketing database.
  • Contact local prosecutor to determine if Agency attorney will need to appear to oppose case(s).
  • Maintain pending file of expunction petitions both contested and uncontested with vigilance of time sensitivity resulting from court appearances and notices of hearings.
  • Provide interpretive assessment, administrative documentation and associated records for CRS Attorney responses to courts.
  • May review, process mail, and distribute expunction, misuse of identity and juvenile sealing petitions/applications and orders.
  • Attend work regularly and observe approved work hours in accordance with agency leave and attendance policies.
  • Perform other duties as assigned.
Qualifications:

GENERAL QUALIFICATIONS and REQUIREMENTS:

Education - Graduation from a standard senior-high school is required.

Graduation from an accredited two-year or four-year college or university with major course work in Law Enforcement, Law, Government or Business Management is preferred.


Experience - Minimum of two (2) years' experience involving concentrated use of personal computers or mainframe integrated terminals plus an additional two (2) years of work experience involving the processing of criminal history records, interpreting legal documents, and/or the preliminary review of criminal cases according to statute requirements.

Substitution Note:

Relevant education, up to two (2) years, may be substituted in lieu of work experience on a year-for-year basis, with thirty (30) semester hours equal to one (1) year education.


Licensure and/or Certification - Must obtain TLETS Terminal Operator Certification within three (3) months of employment.

Regulatory Knowledge - Working knowledge of, or the ability to rapidly assimilate information related to TXDPS, State and Federal regulations, legislation, guidelines, policies and procedures.

Basic knowledge of arrest records, the criminal justice system and how a criminal case proceeds through the criminal justice system for adult and juvenile cases.

Ability to learn and effectively apply expunction and juvenile sealing laws.

Interpersonal Skills - Must demonstrate an ability to exercise poise, tact, diplomacy and an ability to establish and maintain positive, working/professional relationships with internal/external customers.

Organizational and Prioritization Skills - Must be organized, flexible, and able to effectively prioritize in a multi-demand and constantly changing environment; able to meet multiple and sometimes conflicting deadlines without sacrificing accuracy, timeliness or professionalism.

Ability to maintain accurate records of high volumes as they occur regarding active expunction, misuse of identity and juvenile sealing cases.


Presentation/Communication Skills - Must be able to construct and deliver clear, concise, and professional presentations to a variety of audiences and/or individuals.

Research and Comprehension - Must demonstrate ability to quickly and efficiently access relevant information, and be able to utilize and/or present research and conclusions in a clear and concise manner.

Analytical Reasoning/Attention to Detail - Must demonstrate an ability to examine data/information, discern variations/similarities, and be able identify trends, relationships and causal factors, as well as grasp issues, draw accurate conclusions, and solve problems.

Technology (computers/hardware/software/operating systems) - Must possess appropriate levels of proficiency with utilized software and systems and be able to learn new software/systems.
Demonstrated proficiency with Microsoft Office Suite (Word, Excel, PowerPoint, Outlook).

Confidentiality and Protected Information - Must demonstrate an ability to responsibly handle sensitive and confidential information and situations, and adhere to applicable laws/statutes/policies related to access, maintenance and dissemination of information.

Safety - Must be able to work in safe manner at all times, avoiding shortcuts that have potential adverse results/risks, and must be able to comply with safety standards and best practices.

Travel and/or Schedule - Availability for after-hour and weekend work is required.

Retirement Information:


A DPS employee who is selected for a position in the same salary group and state title as their current position will be transferred with no salary change.

A DPS employee who is selected for a position in their current salary group with a new state title may receive an increase of no more than 3.4% over their current salary regardless of posted salary.

Salary is contingent upon qualifications and is subject to salary administration and budgetary restrictions.
