Duties Description As a Senior Attorney focusing on litigation, the incumbent will perform the following duties: -Investigate lawsuits and claims as well as CPLR Article 78 proceedings against the agency and support the Attorney General's Office in its defense of the agency, including assisting with preparation of pleadings, memorandums of law, and affidavits. Issue litigation holds to preserve evidence. Assist the Attorney General's Office with discovery, depositions and trial arrangements. -Represent the agency in administrative proceedings held by State and federal agencies regarding personnel issues and human rights law complaints, including responding to complaints, gathering and producing evidence, preparing witnesses, presenting the agency's case at the hearing and preparing post hearing briefs. -Provide advice and assistance to the Attorney General's Office and staff on issues related to individuals who are involuntarily committed to OPWDD care, are ordered into OPWDD care by a court pursuant to CPL § 730 (lack of fitness to proceed to trial on a criminal charge; or who are under OPWDD supervision pursuant to CPL § 330.20 (not guilty by reason of mental disease or defect).-Review incidents for potential litigation matters and take steps to preserve records. -Provide advice and support to agency staff and representatives on general litigation issues concerning the agency, including discrimination claims and other laws related to human resources. LinkedIn: /company/nys-office-for-people-with-developmental-disabilities/posts/?feedView=all#LI-JB2 Minimum Qualifications Senior Attorney (SG-25):One year of permanent competitive service as an Assistant Attorney 3, or Admission to the NYS Bar and two years of post-licensure professional legal experience.Assistant Attorney 1 (Equated to SG-18):Law School Graduation (or other eligibility to take the NYS Bar Examination).Assistant Attorney 2 (Equated to SG-20):Admission to NYS Bar.Assistant Attorney 3 (Equated to SG-22): One year as an Assistant Attorney 2, or Admission to the NYS Bar and one year of subsequent professional legal experience.Advancement Within the Attorney Traineeship: If you are appointed to one of the entry levels of the Attorney Traineeship, you will normally be advanced after each twelve months of satisfactory service to the next higher title (with salary based on performance) until you reach the full performance level of a Senior Attorney.If you are appointed as an Assistant Attorney 1, you will be automatically advanced to Assistant Attorney 2 upon admission to the New York State Bar. If you are not admitted to the New York State Bar within two years of appointment, your appointment will be terminated.Transfer: Candidates must have one year of permanent competitive or 55-b/c status in the posted title and be eligible for lateral transfer; OR be eligible to transfer via Section 70.1, 70.4, or 52.6 of Civil Service Law.
