Overview: The National Association of Home Builders (NAHB) is seeking an experienced attorney to join its team as a Staff Counsel. This position plays a crucial role in advancing the organization's mission through strategic litigation efforts.

Job Description: As a Staff Counsel, you will be responsible for identifying and analyzing potential litigation opportunities that align with NAHB's goals. You will work closely with various departments to develop and implement legal strategies that support the organization's objectives. Your expertise will help shape the association's approach to energy, finance, and multifamily/single-family housing issues.

Key Responsibilities:
• Collaborate with government affairs, codes, regulatory, and communications staff to ensure seamless coordination between legal efforts and departmental activities.
• Provide expert legal research, analysis, counsel, and opinions to senior staff, other staff, and senior officers on matters related to Administrative Procedure Act, environmental/energy, and other assigned topics.
• Develop and deliver legal education programs for state and local home builder associations and members on federal legal issues.
• Offer in-the-field consultation services to state and local associations as needed, responding to member inquiries on such issues.
• Assist in preparing strategic plans and budgets for individual cases, developing Requests for Proposals (RFPs) for distribution to outside counsel for potential representation in new litigation.
• Participate in selecting appropriate counsel to represent NAHB in proactive litigation, managing outside counsel effectively.
• Contribute to developing and reviewing litigation strategies on a variety of federal housing issues, researching and identifying existing and potential cases of importance to NAHB members.
• Assist in developing and preparing pleadings, briefs, and other court documents for filing in new and active litigation, attending industry coalition meetings.
• Craft amicus briefs for filing in federal and state courts, providing legal research and information to legislative and policy questions for staff at all levels of the association.

Requirements: A minimum of two to six years of relevant legal experience, including knowledge of the Administrative Procedure Act notice and comment process. Proven ability to analyze, research, write, and balance multiple assignments. Strong written and verbal communication skills, strong presentation skills, and demonstrated ability to perform effectively in a team setting with occasional travel required. Experience with federal laws impacting home building, including environmental, finance, and energy statutes, is highly desirable. Ability to work in a cross-disciplinary team environment and interact with NAHB's broad membership is essential. D.C. Bar license or the ability to obtain within a reasonable timeframe is mandatory. U.S. Supreme Court bar admission or the ability to obtain is also preferred. A background in the Federal Administrative Process is considered advantageous.

Work Arrangements: The successful candidate will be expected to work three days in person and two days remotely. Occasional travel may be required, and public speaking and presenting at local/state home-building associations may be necessary.
