Job Overview:

This role requires a combination of legal, regulatory, and compliance knowledge along with strong communication and leadership skills to effectively manage risks within the group's operations.

Responsibilities:

  • Intermediary Role: Act as a liaison between corporate compliance management and management of companies under its responsibility.
  • Regulatory Compliance: Ensure compliance with regulations such as Money Laundering Prevention or Information Protection, becoming the Compliance Officer for relevant matters.
  • Design and Documentation: Create and document risk assessment and internal control systems to support corporate policies regarding ethics and compliance issues.
  • Adoption and Monitoring: Implement and monitor compliance programs tailored to each company's reality and exposure levels.
  • Investigations: Conduct investigations assigned by the Corporate Risk and Compliance Department and follow up on action plans.
  • Policy Supervision: Supervise compliance with corporate policies, report inconsistencies, and define corrective actions.
  • Policy Adoption: Ensure adoption of corporate policies and alignment with senior management guidelines.
  • Review Processes: Centralize coordination with internal supervisory areas to streamline review processes.
  • Remediation: Lead remediation processes for internal control system findings related to ethics and compliance matters.
  • Reporting: Periodically report compliance levels to company management and Corporate Risk and Compliance Function.
  • Ethics Commission Support: Provide support to the Company's Ethics Commission, including conducting investigations and preparing necessary reports.
  • Risk Identification and Mitigation: Identify and report ethics or compliance risks, propose mitigation measures, and ensure policy application.
  • Training: Deliver training programs on risk management, internal control, ethics, and compliance.
  • Due Diligence: Conduct due diligence programs for M&A, important projects, and third-party entities.
  • Continuous Improvement: Establish annual processes to evaluate and improve risk management, internal control, and compliance processes.
  • Risk Assessment: Manage the risk assessment process and monitor action plans for risk management.
  • Policy Implementation: Coordinate and support the implementation of business ethics and compliance management policies.
  • Process Improvement: Implement processes and actions to improve risk management, internal control, and compliance.
  • Other Duties: Undertake other tasks assigned by Corporate Compliance Management.
Knowledge, Skills & Abilities:
  • Education and Experience: Juris Doctor or equivalent degree and licensed to practice in at least one state in the U.S.A. (Arizona, California, Nevada)
  • Additional Education and Experience: Bachelor's Degree in Business Administration or similar with a minimum of 8 years of experience in relevant areas.
  • Certifications: Postgraduate studies in Ethics and Compliance or International Compliance Certification preferred, along with other related certifications.
  • Legal and Regulatory Knowledge: Familiarity with the SOX legal framework, internal control, free competition regulations, environmental regulations, and FCPA.
  • Language Skills: Fluent in spoken and written English, conversational Spanish preferred.
Preferred:
  • Advanced Education: Graduate degree in relevant fields such as Administration, Accounting, or Industrial Engineering.
