**Minimum Qualifications**
For appointment to Assistant Attorney 1:
- Law school graduation and/or eligibility for NYS Bar Admission.*
- If you are appointed as an Assistant Attorney 1, you will be automatically advanced to Assistant Attorney 2 upon admission to the New York State Bar. If you are not admitted to the New York State Bar within two years of appointment, your appointment will be terminated.
**Duties Description**
Responsibilities include, but are not limited to:
- Intake on any specialized litigation, such as Article 78 proceedings against NYSIF based on labor relations (wrongful termination, discrimination, etc.), contracts/procurement (real estate, or challenges to non-award), FOIL challenges, suits stemming from premium collection (outside of the normal collections process), or any other matter in state or federal court; if initial action (extension of time, answer, or motion in lieu of answer) is appropriate, the attorney will act on behalf of NYSIF to make the necessary filing; under the supervision of a unit chief, the employee will engage the Attorney General (AG) in initial and ongoing discussions as to any matter for which the AG represents NYSIF and will closely monitor the case and frequently interact and assist the AG; provide litigation assistance.
- Review the merits of appeal requests by analysis of documents in the Workers’ Compensation Board’s (WCB) eCase and internal NYSIF databases; review of the WCB's digital audio recordings of hearings and depositions, research of applicable law, and case documents; under the supervision of a unit chief, communicate, discuss, and explain to claims department staff the basis for rejections of appeal requests; under the supervision of a unit chief, the drafting of clearly written and persuasive appeals, rebuttals, and memos of law with reference to appropriate case law and statutes to advance NYSIF's interests.
- Review documents (RFP’s, RFQ’s, IFB’s) used in NYSIF contracting and procurement of services and commodities that support the agency's business and its procedural objectives, including review of the development, editing, and the negotiation of contracts and Requests for Proposals ("RFP's"), Requests for Quotes (“RFQ’s”), and other agency agreements; under the supervision of a unit chief, advise Administration, Executive and internal departments on legal issues related to NYS procurement and contract laws in accordance with Workers' Compensation Law, State Finance Law, as well as any communication, directives, and oversight by the Office of the Governor, Office of the State Comptroller, Office of the Attorney General, and Department of Financial Services.

For new State employees appointed to graded positions, the annual salary is the hiring rate (beginning of the Salary Range) of the position. Promotion salaries are calculated by the NYS Office of the State Comptroller in accordance with NYS Civil Service Law, OSC Payroll rules and regulations and negotiated union contracts.

HELPS Program:
This title is part of the New York Hiring for Emergency Limited Placement Statewide Program (NY HELPS).
At a future date (within one year of permanent appointment), it is expected employees hired under NY HELPS will have their non-competitive employment status converted to competitive status, without having to compete in an examination. Employees will then be afforded with all of the same rights and privileges of competitive class employees of New York State. While serving permanently in a NY HELPS title, employees may take part in any promotion examination for which they are qualified.
