Draft, negotiate, and review complex and sensitive real property-related agreements such as residential and general lease agreements, conservation easements, agricultural leases and grazing permits, land management agreements, licenses, entry permits, temporary use agreements, and memoranda of understanding. Prepare legal opinons, memoranda, and correspondece related to the use or transfer of land owned and/or controlled by CDFW. Oversee complex aspects of CDFW's real estate related work associated with mitigation pursuant to federal and state laws, including primarily the California Endangered Species Act. Mitigation-related work includes negotiating, drafting, and legal review of complex mitigation/conservation banking agreeements, as well as legal analysis of encumbrances and other issues affecting the bank property. Conduct legal research and advise senior management, including deputy directors and Director, on the most complex legal real estate issues. This advice will also be provided to representatives from the Natural Resources Agency and Governor's Office, as appropriate. Assist with Native American tribal matters, including land transfers, reburial of artifacts and remains, and associated agreements and memoranda of understanding. Mentor and advise CDFW attorneys on real estate issues. Facilitate monthly conservation easement and real estate meetings within the Office of General Counsel. Oversee complex litigation and work closely with the Office of the Attorney General on matters related to CDFW lands.

Working Conditions

Maintain normal and consistent work hours, averaging 40 hours per week. Work in excess of 40 hours per week is expected, when necessary, to complete assignments in a timely manner. Position may require the Incumbent to sit for long periods of time. Light lifting or reaching may be required, though reasonable accommodation may be provided upon request. This position will be located in Sacramento and is eligible for a hybrid telework schedule depending on operational needs. Occasional travel may be required within the state of California via private or public transportation (i.e., automobile, airplane, etc.). Travel may include overnight stays dependent upon departmental need.
