Requirements

Key Responsibilities:

  1. Patent Drafting: Draft and prepare patent applications, including specifications, claims, and drawings, based on inventor disclosures, technical documents, and patentability assessments, ensuring compliance with patent laws and regulations.
  2. Patent Prosecution: Prosecute patent applications before the United States Patent and Trademark Office (USPTO), including responding to office actions, conducting examiner interviews, and drafting appeal briefs, to secure patent grants for clients.
  3. Patent Searching: Conduct patent searches and prior art searches using databases such as USPTO, WIPO, and commercial patent databases, to assess patentability, freedom-to-operate, and infringement risks for client inventions.
  4. Technical Analysis: Analyze technical documents, research papers, and product specifications to understand and evaluate the novelty, inventiveness, and patentability of client inventions, providing technical assessments and recommendations to attorneys and clients.
  5. IP Strategy: Provide strategic IP counseling to clients, including patent portfolio management, IP risk assessment, and competitive analysis, to help clients maximize the value of their IP assets and achieve their business objectives.
  6. Client Interaction: Interact with inventors, engineers, and stakeholders to understand invention disclosures, clarify technical details, and educate clients on patent processes, requirements, and strategies.
  7. Patent Portfolio Management: Manage patent dockets, deadlines, and filings for clients, ensuring timely responses to office actions, maintenance fee payments, and other patent-related activities.
  8. IP Due Diligence: Conduct IP due diligence reviews for mergers, acquisitions, and licensing transactions, assessing the strength and scope of patent portfolios, and identifying potential risks and opportunities.
  9. Legal Research: Conduct legal research on patent laws, regulations, and precedents, staying abreast of changes in patent law and practice, and providing guidance to attorneys and clients on IP-related matters.
  10. Documentation: Prepare and maintain detailed documentation of patent prosecution activities, including correspondence, office actions, and prosecution histories, ensuring accuracy and completeness of patent records.

Qualifications:

  • Bachelor's or Master's degree in Engineering, Science, or related technical field.
  • Registered Patent Agent with the United States Patent and Trademark Office (USPTO), or eligible to sit for the patent bar exam.
  • 3+ years of experience in patent prosecution, drafting, and counseling, preferably in a law firm, IP consultancy, or corporate environment.
  • Strong technical background and understanding of a technical field relevant to client industries, such as electrical engineering, computer science, mechanical engineering, or biotechnology.
  • Excellent written and verbal communication skills, with the ability to convey complex technical and legal concepts clearly and effectively to diverse audiences.
  • Strong analytical and problem-solving skills, with the ability to conduct thorough patent searches, assess patentability, and respond to office actions effectively.
  • Ability to work independently and manage multiple patent prosecution matters simultaneously, while adhering to deadlines and quality standards.
  • Proficiency in patent prosecution tools and software, including USPTO's Patent Application Information Retrieval (PAIR) system, docketing software, and patent search databases.
  • Familiarity with patent laws, regulations, and procedures in the United States and other jurisdictions, and ability to stay updated on changes in patent law and practice.
