Job Description

A pre-litigation attorney provides legal representation to clients who have purchased defective vehicles that qualify under state or federal lemon laws. This role involves advising clients on their rights, negotiating with manufacturers or dealerships, and, if necessary, representing clients in court.

Key Responsibilities

  1. Client Consultation

    • Conduct initial consultations with clients to understand the details of their cases.
    • Evaluate whether a vehicle qualifies as a "lemon" under relevant state or federal laws.

  2. Case Management

    • Collect and review documentation related to the defective vehicle, including purchase agreements, repair records, and communication with the manufacturer or dealer.
    • Maintained organized case files and tracked deadlines and important dates.

  3. Legal Research and Analysis

    • Research applicable lemon laws and legal precedents.
    • Analyze the strength of the client's case and develop a legal strategy.

  4. Negotiation and Settlement

    • Communicate and negotiate with vehicle manufacturers, dealerships, and their legal representatives.
    • Strive to reach a fair settlement for the client, which may include vehicle replacement, repair, or financial compensation.

  5. Litigation

    • Prepare legal documents, including complaints, motions, and discovery requests.
    • Represent clients in court proceedings, including trials and hearings.
    • Present evidence, argue motions and cross-examine witnesses.

  6. Client Communication

    • Keep clients informed about the progress of their cases and explain legal options and potential outcomes.
    • Guide the legal process and manage client expectations.

Required Qualifications

  • Education: Juris Doctor (JD) degree from an accredited law school.
  • Licensure: Admission to the state bar where the attorney will practice.
  • Experience: Previous experience in consumer protection law, particularly lemon law, is preferred.
  • Skills:
    • Strong analytical and research skills.
    • Excellent written and verbal communication skills.
    • Negotiation and conflict resolution abilities.
    • Litigation and trial experience.
