General Description

The Contract Compliance Office (CCO) is an integral part of ensuring that SFMTA adheres to Local, State, and Federal codes and regulations.

CCO administers programs of compliance with labor laws, workforce policies, and equal opportunity/affirmative action in contracting. This is the full journey level class in the Contract Compliance series.

Under the direction of the Disadvantaged Business Enterprise Liaison Officer (DBELO), this position will ensure the SFMTA is in compliance with the federal Disadvantaged Business Enterprise (DBE) Program.

The incumbent researches and analyzes firms for DBE Program requirements.

This includes processing new DBE Certification Applications and maintaining annual and 5-year updates on firms that have been certified by the SFMTA.

This also includes but is not limited to the need to suspend and/or decertify firms no longer eligible for the program.

This individual serves as the primary point of contact for the SFMTA within the California Unified Certification Program (CUCP) which is comprised of several certifying agencies under a Memorandum of Agreement (MOA) reviewed and approved by the U.S.

Department of Transportation (DOT) which outlines DBE Program requirements pursuant to 49 CFR Part 23 & 26.

Examples of Important and Essential Duties:

  • Administers the Diversity Program for Contracts in compliance with Federal Transportation Administration (FTA) and Federal Highway Administration (FHWA) pursuant to 49 CFR Parts 23 & 26.
  • Creates and implements the SFMTA's DBE/SBE program policies and procedures.
  • Independently considers options for program effectiveness and determines courses of action to implement new strategies and techniques to ensure program improvement.
  • Recommends and advises senior management regarding DBE/SBE program policy changes.
  • Interprets federal regulations and determines methodologies used to develop, monitor and report DBE/SBE program goals to the FTA and related activities required for SFMTA contracting opportunities.
  • Analyzes data and regularly crafts and submits audit reports to FTA and DOT.
  • Independently identifies, investigates and recommends solutions to resolve issues/complaints/protests involving public challenges that arise in the administration of the DBE/SBE program.
  • Provides program direction to management regarding the interpretation and application of FTA/FHWA guidelines, reporting and procedures.
  • Represents the SFMTA on a variety of committees conducting and/or coordinating outreach events and activities; including participation in the Business Outreach Committee to educate small/disadvantaged businesses about contracting opportunities and to improve DBE/SBE participation.
  • Responsible for on-site FTA compliance reviews for contractor projects by preparing documents in response to FTA Triennial Review audits and meeting with auditors as the subject matter expert.
  • Attends comprehensive trainings to remain current on DOT regulations; participates in professional organizations and group meetings.
  • Performs other related duties and responsibilities as assigned.
How to qualify

Minimum Qualifications:

Education:


Possession of a baccalaureate degree from an accredited college or university with major coursework in industrial relations, social sciences or a related field.


Experience:
Six (6) years of experience reviewing, monitoring, and developing contract or other compliance programs involving contracts, ordinances or vendors.

Such experience must have included:
a) Providing technical direction on procurement, negotiation, and contract bidding procedures to ensure compliance with all contract requirements; OR
b) Promoting equal opportunity, affirmative action and non-discrimination objectives in contracting; OR
c) Monitoring and enforcing prevailing wage, wage and hour laws, or labor standards; OR
d) Construction contracts or construction management experience in monitoring and enforcing prevailing wage, wage and hour laws, or labor standards; OR
e) Public policy or program development related to health care coverage/ access or family work-life balance; OR
f) Reviewing, monitoring and enforcing workforce development policies.

Desirable Qualifications:
Specific and Demonstrated experience with implementation of Local Business Enterprise, Disadvantaged Business Enterprise, and/or Small Business Enterprise programs.
Specific and Demonstrated experience implementing small business Certification programs.
Experience with the Unified Certification Program (UCP).
